The standard lets a token issuer decide who may receive it, freeze balances, seize them and, depending on the rules it chooses, move them without the holder&#8217;s consent. The checks \t\u2014 identity, sanctions, any transfer rule the issuer encodes \t\u2014 run on every movement, including those between different wallets and services.<\/p>\n<p>The technical specification contains one detail that says more than the announcement itself: it advises lending services to <strong>examine those powers before accepting the token as collateral<\/strong>. In other words, the standard itself acknowledges that an asset with a kill switch is not worth the same as one without.<\/p>\n<h2>From perimeter to substrate<\/h2>\n<p>For a decade, regulatory compliance in crypto was enforced at the perimeter: exchanges, custodians, VASPs, on- and off-ramps. The asset was neutral; control sat at the points where that asset touched the traditional financial system. That meant the regulatory unit of analysis was the entity \t\u2014 licensable, inspectable, sanctionable \t\u2014 and not the instrument.<\/p>\n<p>CIP-0113 inverts that order. The rules, in the words of Frederik Gregaard, the foundation&#8217;s chief executive, &#8220;have to travel with the asset and apply every time it moves&#8221;. Technically this is not entirely new: Ethereum has ERC-3643, Solana added transfer controls via token extensions and the XRP Ledger lets issuers restrict holders and perform <em>clawbacks<\/em>. What matters is not who got there first, but that the capability is becoming a market requirement across every chain that wants to host regulated assets. When four ecosystems build the same primitive in parallel, they are not competing over an innovation: they are responding to the same demand from issuers.<\/p>\n<p>And that demand has names attached. A fund sold only to verified investors needs to reject transfers to anyone who has not completed KYC. A stablecoin issuer needs to stop its tokens reaching a sanctioned address. A bank tokenising a bond needs to be able to execute a court order against that bond. Without those capabilities, the asset simply cannot be issued under most regulatory frameworks. The Cardano Foundation underlined the point by simultaneously announcing recognition under the certification framework of the Capital Markets and Technology Association, the Swiss body whose standards are used to issue tokenised shares. The target audience is not DeFi users.<\/p>\n<h2>The digital gilt is not a footnote<\/h2>\n<p>This is where the technical piece connects to what is really at stake. The United Kingdom <a href=\"https:\/\/cointelegraph.com\/news\/uk-taps-6-banks-to-lead-first-digitally-native-government-bond\">has appointed six banks<\/a> to lead its first digitally native sovereign bond. A public debt instrument issued onchain cannot allow anyone to transfer it to anyone: the issuer is a state, the register has legal effect and the sanctions regime applies to every holder. A digital gilt requires, by construction, exactly what CIP-0113 standardises.<\/p>\n<p>That changes the conversation about tokenisation. The usual argument \t\u2014 T+0 settlement, collateral mobile 24\/7, fractionalisation \t\u2014 assumes the advantage is operational. But the bottleneck was never settlement speed; it was the ability to reproduce onchain the control powers that securities law takes for granted: precautionary freezes, attachment, reversal of fraudulent transactions, segregation of holders by jurisdiction. Tokenised sovereign debt arrives with those controls or it does not arrive at all.<\/p>\n<p>So the operational question for the next eighteen months, for anyone building in custody, treasury or tokenisation, is not whether the asset settles instantly. It is <strong>who can switch it off, under what evidentiary standard and with what route of appeal<\/strong>.<\/p>\n<h2>Conduit: power without procedure<\/h2>\n<p>Today, the answer to that question is uncomfortable. On 6 October Conduit <a href=\"https:\/\/www.theblock.co\/news\/regulation\/2026-10-06-conduit-sues-tether-usdt-freeze-417831\">sued Tether<\/a> over $2.76 million frozen for roughly a year, arguing that the issuer has &#8220;no legal right&#8221; to those funds. The freeze is said to have occurred in the context of a Brazilian investigation, with no US court order against a US company, and no sustained explanation to the holder.<\/p>\n<p>Tether has for years exercised de facto the power that CIP-0113 turns into infrastructure. The difference between the two cases is instructive: Tether does it as the discretionary decision of a private company, case by case, on unpublished criteria. CIP-0113 does it as a protocol function, declared in the token&#8217;s specification and, in theory, auditable. Standardisation is an improvement in transparency. What it does not solve is the underlying problem Conduit illustrates: <strong>the power to freeze exists long before the procedure to challenge it<\/strong>.<\/p>\n<p>None of the standards \t\u2014 not CIP-0113, not ERC-3643, not token extensions \t\u2014 defines a maximum freeze period, a duty to give reasons, an appeals body or a rule on who bears the opportunity cost of immobilised funds that turn out to be lawful. They are execution specifications, not guarantees. Procedural rights are assumed to be imported from the offchain world, unless the issuer sits in a jurisdiction where those rights are not easily enforced against it.<\/p>\n<h2>The state delegates enforcement<\/h2>\n<p>On that same 6 October, FinCEN published in the Federal Register the <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/10\/06\/2026-20429\/proposal-of-special-measure-regarding-convertible-virtual-currency-mixing-as-a-class-of-transactions\">withdrawal of its proposed special measure on crypto mixers<\/a>, the rule published in October 2023 that would have designated convertible virtual currency mixing as a class of transactions of primary money laundering concern. Two pages in the Federal Register to dismantle three years of categorical <em>rulemaking<\/em>.<\/p>\n<p>Read together, the two moves describe a shift. The state is retreating from regulation by category \t\u2014 banning a class of transaction, defining a perimeter \t\u2014 while control migrates to the asset layer, where the issuer exercises it. This is not deregulation: it is outsourcing. The surveillance function does not disappear, it changes hands. And the new holder is a private entity that, in the Conduit case, happens to be an offshore issuer effectively enforcing a third jurisdiction&#8217;s investigation against the funds of a company from a fourth.<\/p>\n<p>That is the geopolitical dimension the technical coverage skips. A token with embedded rules exports the issuer&#8217;s policy to every jurisdiction where it circulates. If a Swiss issuer encodes a sanctions list, that list applies to a holder in S\u00e3o Paulo without any Brazilian authority having intervened. Extraterritoriality stops depending on mutual legal assistance treaties and starts depending on the logic of a smart contract.<\/p>\n<h2>When the decision-maker is a machine<\/h2>\n<p>The next step up is already built, even if not yet deployed at scale. The <em>screening<\/em> that triggers a freeze is automatic: sanctions lists, address risk scores, heuristics from chain analytics providers. If payments are also initiated by autonomous agents \t\u2014 the use case much of the industry is chasing for stablecoins \t\u2014 seizure stops being an occasional discretionary act and becomes a function of machine latency.<\/p>\n<p>A false positive on a risk list no longer means a transfer held up pending manual review. It means a balance immobilised in milliseconds, possibly while the agent that was due to pay a payroll or top up collateral keeps retrying. The evidentiary standard justifying the freeze becomes a model&#8217;s confidence threshold, and the appeal \t\u2014 if one exists \t\u2014 is processed on human timescales against a decision taken on machine timescales. Nobody has yet written the rules for that asymmetry.<\/p>\n<h2>What would disprove this reading<\/h2>\n<p>There is a far more benign interpretation, and it may well be the right one. CIP-0113 and its equivalents could remain confined to a narrow lane: regulated securities, institutional funds, sovereign debt. Instruments where the holder <em>knows<\/em> they are buying an asset with controls, just as they know a registered share is not a bearer note. The open market \t\u2014 bitcoin, ether, ADA, general-purpose stablecoins \t\u2014 would keep operating without those controls, and the system would end up with two clearly separated lanes rather than a universal substrate of surveillance.<\/p>\n<p>The evidence supporting that reading would be observable: adoption concentrated in institutional issuance, visible price discounts or collateral haircuts for tokens with seizure powers, and the emergence of case law or contractual clauses limiting those powers before they become widespread. If within twelve months lending protocols apply explicit <em>haircuts<\/em> to assets with <em>clawback<\/em> \t\u2014 precisely what Cardano&#8217;s specification suggests they should \t\u2014 the market will be pricing kill-switch risk, which is the healthiest way to discipline it.<\/p>\n<p>The contrary evidence is equally observable: controls spreading to mass-market retail stablecoins, freezes executed with no deadline and no reasons given, as in the Conduit case, and a court outcome confirming that an issuer can immobilise funds for a year at no cost. In that scenario, the narrow lane does not exist.<\/p>\n<h2>What this forces you to do<\/h2>\n<p>For anyone building product: kill-switch risk is now a design variable, not a legal assumption. If your protocol accepts regulated tokens as collateral, you need to read the rules embedded in each one and model what happens to a leveraged position when the issuer freezes the collateral halfway through a liquidation. Cardano&#8217;s specification warns about this explicitly; treat it as an integration requirement, not as small print.<\/p>\n<p>For anyone managing treasury: due diligence on a stablecoin or a tokenised fund has to include questions almost nobody asks today. What procedure does the issuer follow before freezing? Does it notify? How quickly does it respond to a challenge? Which jurisdiction resolves the dispute, and is a judgment in my favour enforceable there? Conduit has spent a year without those answers and has had to go to court to get them.<\/p>\n<p>For anyone investing: the spread between assets with and without seizure powers is not yet in prices. When it is \t\u2014 and lending protocols will be the first to put it there, because they are the ones who absorb the loss \t\u2014 there will be a repricing that distinguishes tokens whose value depends on the issuer&#8217;s conduct from tokens whose value does not.
