Congress<\/a><\/h4>\n                                <!-- <p>On 17 September 2026 the SEC issued an order temporarily exempting Tokenized Securities Venues (TSVs) from the definition of an \u00abexchange\u00bb under the Exchange Act of 1934, allowing them to trade tokenized NMS stocks through automated market makers and permissioned liquidity pools. The exemption expires five years after its publication in the Federal Register. A day later, the CFTC sent its own draft rules for crypto markets to the White House Office of Management and Budget, without disclosing the contents. All of it in the same week the Clarity Act ran out of road in the Senate. Coverage has treated these as three separate stories. They are one operation: in the absence of legislation, the agencies are building the structure of the US capital markets with soft law. It is fast, it is reversible, and it changes the risk calculus for anyone building on top of it. What the exemption actually permits The visible part is that a TSV can match buyers and sellers of tokenized stock without registering as an exchange. The part that matters sits in the order&#8217;s second paragraph: the SEC also grants a conditional exemption from the \u00abdealer\u00bb definition in Section 3(a)(5) to liquidity providers in those pools who commit their own capital, even if they also quote prices to customers or undertake to supply capital. Without that second exemption, any firm acting as a liquidity provider in an AMM for US equities would be engaged in unregistered dealing. That is what unlocks having someone on the other side of the trade. The conditions fence the experiment in: Caps on the number of tradable symbols and on volume. The token must confer on its holder the same rights and privileges as the traditional share of that class. If the tokenization was carried out by an unaffiliated third party, the TSV must notify the issuer of the underlying stock in writing and give it an opportunity to object. Smart contracts must be auditable, public and deployed on a public, permissionless chain. The TSV must halt trading in a tokenized security at the same time as trading is halted in the underlying on its primary listing market. Disclosure of its own operations, its trading activity and that of its affiliates on the TSV itself. It is a curious architecture: public contracts on a permissionless chain, but permissioned participants. Transparency goes to the code; control goes to the admissions list. And the issuer of the stock gets a right of objection that, until tested, functions as a reputational veto over who tokenizes its shares. Legislation replaced by a signature An exemption is not a statute. It is granted by order, amended by order and revoked by order. The SEC has also opened a comment period on \u00aball aspects\u00bb of the exemption, a sign that the text itself is considered provisional. Chairman Paul Atkins described it as an \u00abimportant first step\u00bb while the Commission weighs whether further measures are needed. The CFTC is working with the same toolkit. Its draft sits at OMB; when it comes back, it will need a vote, a comment period and a second vote before taking effect: months of process, every stage of it reversible. In the meantime, the agency issued a no-action letter allowing certain passive software providers \u2014including crypto wallet interfaces\u2014 to connect users with regulated derivatives markets without registering as introducing brokers. They can promote specific contracts and charge per-transaction fees, but cannot custody client assets, generate buy or sell signals, or control routing and execution. The relief lasts until the CFTC adopts rules of its own. Its chairman, Mike Selig, summed it up on X: \u00abThe CFTC is ready to send its rules for the new frontier of finance\u00bb. Translation: the regulatory framework for the next eighteen months does not live in the US Code, it lives in exemptive orders, no-action letters and self-regulatory approvals. A different majority at the Commission can change it without going near Congress. That is the price the industry is paying for speed, and it is worth saying out loud, because for two years the sales pitch was exactly the opposite: that only legislation would deliver lasting certainty. The geopolitical piece: repatriating the perp None of this makes sense as purely domestic policy. The most liquid product in global crypto markets \u2014the perpetual future\u2014 and its most awkward derivative \u2014synthetic exposure to US equities\u2014 have operated outside the US for years, concentrated on offshore venues and, above all, on Binance. An investor in Jakarta or Istanbul can hold leveraged exposure to Nvidia without touching any SEC-regulated infrastructure. That liquidity generates fees, market data and price-setting power beyond the American perimeter. That is where the applications to list single-stock perpetuals \u2014Apple, Tesla, Nvidia\u2014 filed by Coinbase fit in, alongside parallel moves from Kalshi and Bitnomial. Combined with the SEC&#8217;s exemption on tokenized spot and the no-action letter that turns a wallet into a legal shop window for regulated derivatives, they add up to a full stack: onchain spot, leveraged derivative and crypto-native distribution, all inside the US. The contrast with Europe is telling: as CoinDesk reported citing the WSJ, the ECB president intervened to block Binance&#8217;s MiCA licence in the EU. One jurisdiction is building on-ramps; the other is putting up barriers. Who prices Apple at three in the morning This is the axis almost nobody is discussing. The requirement that a TSV halt in sync with the primary market works as long as the primary market is open. The order sets no trading hours for TSVs, and that leaves an enormous grey zone: if an automated pool keeps quoting while the NYSE and Nasdaq are closed, there is no opening auction, no reference circuit breaker and no official price against which to suspend. In an AMM, price is not formed by an order book with humans behind it: it is set by a curve and corrected by arbitrage. There was no contract, no regulator, no verification mechanism. There was an essay by Amodei laying out a three-step proposal \u2014 external auditors embedded inside the labs, domestic regulation and a global slowdown agreement \u2014 plus several public nods. On Monday, Nvidia, Intel and AMD fell, bitcoin rose and traded around $76,900, and Donald Trump phoned Jensen Huang while Huang was on stage at the All-In Summit in Los Angeles to tell him that worrying about AI is &#8220;a hoax&#8221;. That is the relevant fact: a verbal agreement between four people moved the price of global compute infrastructure in a single session. It was not moved by a rule, or a fine, or a shift in demand. It was moved by a signal of intent. In any other market that has a precise name: guidance. And whoever issues credible guidance on a scarce asset is not doing applied ethics, they are doing monetary policy. Compute is this decade&#8217;s monetary base The analogy is worth taking seriously because it is structural, not rhetorical. A central bank sets the price of money by regulating the quantity available and, above all, by communicating the future path of that quantity. Ninety per cent of the effect sits in the expectation, not the operation. That is why Fed minutes move curves before anything is executed. In frontier AI, the equivalent scarce asset is the combination of committed compute capacity and the reachable capability frontier. Four firms account for a disproportionate share of demand for high-end accelerators, of take-or-pay contracts with clouds, and of the multi-year commitments that underwrite capex across the supply chain. When those four firms hint that they will slow the rate at which they push capability, they are communicating a demand path. The market does not wait to see whether they follow through: it reprices. The most interesting concrete proposal in the whole episode points in exactly that direction. Daniel Kokotajlo&#8217;s AI Futures Project \u2014 Kokotajlo is a former OpenAI researcher \u2014 argues that labs should open their compute budgets to auditors and commit to cutting them significantly for research. Translated: a verifiable quantitative target on the scarce aggregate, with a third party validating the number. That is not a code of conduct. It is a targeting regime with independent oversight. The institutional architecture is identical to a central bank&#8217;s, with the difference that nobody granted the mandate. Competition law has no doctrine for this Here is the hole. An agreement among the four largest operators in a market to cap the rate of product improvement and cut R&amp;D spending is, in any antitrust textbook, an immediate candidate for a restraint of competition: a horizontal agreement limiting output and innovation. Classic cartels do precisely this, and they have spent decades dressing it up as an industry standard, a quality code or an environmental commitment. The problem is that the defence here is not obviously false. If the risk being invoked is real \u2014 Amodei identifies recursive self-improvement as the trigger, and Anthropic has said that threshold could arrive in early 2027 \u2014 then limiting cadence has a public-interest justification no cement cartel could ever claim. And competition law lacks an operational test to distinguish &#8220;we coordinated so as not to cause catastrophic harm&#8221; from &#8220;we coordinated so we wouldn&#8217;t have to compete and, incidentally, to shut out open source&#8221;. It is not that the answer is hard: it is that the test does not exist. The criticisms gathered by The Verge land exactly there. Sacha Haworth, of the Tech Oversight Project, puts it bluntly: any voluntary framework is regulatory capture and &#8220;we shouldn&#8217;t let the foxes run the henhouse&#8221;. Kokotajlo fears the middle scenario, which is the most likely one: &#8220;they&#8217;ll bring in external auditors, they&#8217;ll do a lot of safety paperwork \u2014 some of it genuinely good \u2014 but at the end of the day it won&#8217;t slow them down much&#8221;. Nick Reese, former director of emerging technology policy at DHS, compares the move to the social platforms&#8217; playbook a decade ago, when they asked for regulation in order to pre-empt something worse. And one detail settles a great deal: the calls for a slowdown are aimed exclusively at frontier labs defined by exact size metrics. Compute thresholds, de facto. That is defensible on safety grounds and, simultaneously, it is the cleanest way to build a barrier to entry: whoever is already inside negotiates the threshold; whoever comes next inherits it. Why capex is the real transmission channel The financial side is where this stops being a think-tank debate. AI capex is being financed with structures that assume a rising, uninterrupted demand curve: corporate debt, data centre leasing vehicles, multi-year purchase commitments, valuations that discount future capacity already sold. All of that scaffolding is sensitive to duration, not to level: an eighteen-month delay in the capability curve does not reduce total demand, but it wrecks the amortisation schedule of anyone who built for a peak that now arrives later. Which is why a statement with no contract behind it moves silicon makers and infrastructure operators before it moves the labs themselves. And why Decrypt reported the reaction it did: bitcoin up while Nvidia, Intel and the rest of the semis fell. The simple reading is &#8220;rotation into an uncorrelated asset&#8221;. The more useful reading is different: the AI trade has become a policy trade, and anyone exposed to it needs a hedge against discretionary decisions by four chief executives and one president. Bitcoin is not a good hedge against AI; it is simply the most accessible liquid asset that does not depend on the GPU deployment calendar. The US Treasury sanctioned Xinbi Guarantee, another Telegram-based guarantee marketplace built to cash out the proceeds of global scams. The Secret Service froze $52.8 million in crypto assets tied to that bazaar. And TRM Labs announced it had doubled its valuation to $2 billion in a Series C extension led by Blockchain Capital, with annual recurring revenue up fourfold in three years. Coverage treated the first item as policy and the third as venture capital. They are the same circuit. An OFAC designation aimed at crypto infrastructure doesn&#8217;t rest on a name and a passport: it rests on a set of addresses clustered, labelled and attributed to an entity. That work \u2014 the clustering, the common-spend heuristic, the &#8220;illicit marketplace&#8221; tag, the tracing of funds across bridges and mixers \u2014 is done mostly by three or four private companies. And one of them has just doubled its price. The layer that matters isn&#8217;t asset classification The visible regulatory debate is still anchored in whether a token is a security or a commodity, who supervises what and under which licence. Meanwhile, operational power has shifted to a different layer: attribution. Deciding that address X belongs to cluster Y, that the cluster is the treasury of a designated entity and that, therefore, any counterparty touching it incurs sanctions risk. That decision has immediate consequences \u2014 frozen funds, closed accounts, rejected deposits \u2014 and it happens outside the classic administrative procedure. TRM says its software is used by more than 600 government agencies and private institutions across 75 countries. In July, ICE awarded it a sole-source contract worth roughly $95 million over one year for forensic software and support to the Homeland Security Task Forces. Chainalysis challenged the award in federal court, calling it &#8220;arbitrary, capricious and unreasonable&#8221;. The litigation is revealing for what it disputes and what it doesn&#8217;t: the contract is being fought over, not the method. No one is asking a court to open up the attribution model. This is the structural problem. When a bank rejects a transfer because of a conventional AML alert, there is a procedure, a supervisor, and an imperfect but real right to an explanation. When an exchange blocks a withdrawal because a blockchain intelligence provider assigned a high risk score to the originating address, the user has no idea which model decided it, on what training data, with what error rate, or to whom to appeal. The provider isn&#8217;t a party to the procedure: it&#8217;s an input. But its output functions de facto as administrative evidence with no right of rebuttal. The addressable market is labelled crime TRM&#8217;s announcement includes two figures worth reading together. Losses from digital crime reported to the FBI&#8217;s IC3 rose to $21 billion in 2025 from $16 billion in 2024. And the company argues, citing its own AI-in-Crime Adoption Index, that criminal adoption of AI grew 40% year on year in 2026. There&#8217;s no reason to think those figures are false. There is reason to point out that the vendor of the solution is also the producer of the statistic that sizes the problem. In any other sector that would be called a methodological conflict of interest and independent verification would be demanded. In blockchain analytics it gets cited as market data \u2014 including in this piece. The bias isn&#8217;t necessarily bad faith: providers measure what their own system labels, and a system that expands labelling coverage detects more crime by construction, even if the underlying crime isn&#8217;t growing at the same rate. The economic incentive points in one direction only. A chain intelligence firm&#8217;s valuation grows with the volume of activity classified as illicit, with the number of jurisdictions mandating screening, and with the depth of screening obligations. A false negative \u2014 letting funds from a sanctioned entity through \u2014 is a reputational and contractual disaster. A false positive \u2014 flagging a clean address \u2014 is a cost borne by the end user, who has no channel to contest it. Systems get calibrated towards whatever hurts the seller least. When AI replaces the analyst TRM describes its expanding business as &#8220;AI-powered investigations&#8221;. It&#8217;s the logical lever: manual attribution doesn&#8217;t scale to 75 countries or hundreds of thousands of clusters, and automating it improves margins. But it changes the nature of the error. Classic attribution combined deterministic heuristics \u2014 common spend, address reuse \u2014 with human intelligence: leaks, test purchases, KYC data from cooperating exchanges, forum analysis. An analyst could explain why a cluster belonged to a specific entity. A model trained on behavioural patterns produces a probability, and that probability propagates: if cluster A is attributed by inference and cluster B is linked to A by transactional proximity, the error is inherited. In a network where risk spreads by hops, a false positive doesn&#8217;t affect one address: it affects its whole neighbourhood. Nobody publishes error rates. There is no benchmark dataset, no cross-evaluation between providers, no obligation to preserve a record of why an address received a given label on a given date. Anyone who has compared two providers across the same set of addresses knows they disagree, sometimes markedly. That divergence is the empirical proof that we are dealing with judgements, not instrument readings. Buying the software means importing the jurisdiction The geopolitical dimension is the least discussed. The designation lists feeding these tools are, at their core, American: OFAC defines who is outside the system. A financial intelligence unit in Latin America, Southeast Asia or the Gulf that deploys this software isn&#8217;t acquiring a neutral crime detector; it is adopting a risk map built on someone else&#8217;s foreign policy priorities and on a tolerance threshold set in Washington. The result is an extraterritorial extension that requires no treaty and no transposition into national law. It&#8217;s bought on an annual licence.
